CJP considers making larger bench in A.D. Khowaja posting case


ISLAMABAD: Chief Justice of Pakistan (CJP) Mian Saqib Nisar has said that he will consider constituting a larger bench to determine the jurisdiction of provincial and federal governments regarding posting of Sindh police inspector general.

The Supreme Court (SC) was hearing the petition filed by the Sindh government against a verdict of Sindh High Court (SHC) which restricted the provincial government to replace the Sindh Inspector General A. D. Khowaja.

Last year, the SHC ordered to reinstate Khowaja after the Sindh government said it is handing over the IGP’s services to the federal government. The provincial government also appointed Additional IG Sardar Abdul Majeed Dasti as the acting police head until posting of a regular officer by the Establishment Division.

As the hearing resumed today, the Sindh government lawyer Farooq H. Naek argued before the top court that SHC’s verdict is against the 18th Amendment of the constitution.

Earlier, the SC has ordered that Khowaja would remain police chief with full powers of making postings and transfers until the top court issues a verdict against the petition of the provincial government regarding police chief’s retention.
